Whether the payments are taxable under a transaction agreement depends on what relates to the payment in question. A set of termination measures in a transaction contract generally includes various contractual and non-contractual elements, some of which may be subject to income tax and some of which may be tax-exempt. The tax situation of termination packages is complex, so this answer offers only a summary. The nature of the event that leads to the termination of employment is another factor that can further complicate the tax situation. The employer should first accurately identify each payment as part of the redundancy package and then take into account the tax rules applicable to it.
